In California, rape is defined under Penal Code Section 261 as non-consensual sexual intercourse accomplished through force, threats, fraud, or when the victim is incapable of giving legal consent due to intoxication, unconsciousness, or disability.
The penalties for rape in California are severe and include:
- Prison Time: A conviction typically carries a sentence of 3, 6, or 8 years in state prison.
- Sex Offender Registration: Lifetime registration as a tier-three sex offender under California’s Megan’s Law.
- Fines: Up to $10,000.
- Additional Penalties: If the victim suffered great bodily injury, an additional 3 to 5 years in prison may be imposed.
These penalties reflect the seriousness with which California treats this crime.
A doctor in California can lose their medical license if they are convicted of rape. The Medical Board of California takes allegations of sexual misconduct very seriously. If a doctor is found guilty of rape, it can lead to the revocation of their medical license.
The disciplinary actions for such offenses are governed by the Business and Professions Code Section 2246, which mandates that any proposed decision containing a finding of fact that the licensee engaged in multiple acts of sexual exploitation must include an order of revocation. This means that the doctor’s license would be revoked and they would no longer be allowed to practice medicine.
