These male suspects broke into an apartment office on Sullivan and took about $4,000 worth of tools, supplies, and personal property, according to the Irvine Police Department.

The suspects are both African American. One of them had short hair, a goatee and was wearing a long-sleeved shirt and sunglasses. The other was bald and was wearing a black hoodie with a printed graphic. Their appear to be in their 20’s to 30’s.

Based on the reported incident, the suspects could face several felony charges under California law. Here are the potential penalties:

  • Burglary (Penal Code § 459)
    • Entering a building with intent to commit theft or another felony
    • If charged as second-degree burglary (commercial), penalty is up to 3 years in county jail
    • If charged as first-degree (residential), penalty is 2 to 6 years in state prison
  • Grand Theft (Penal Code § 487)
    • Theft of property valued over $950 (e.g., $4,000 worth of items)
    • Felony offense
    • Penalty: up to 3 years in county jail
  • Possession of stolen property (Penal Code § 496)
    • Applies if suspects were found with stolen items
    • Penalty: up to 3 years in county jail
  • Conspiracy to commit a crime (Penal Code § 182)
    • If both suspects planned the burglary together
    • Penalty: same as the intended felony (e.g., burglary or theft)
  • Restitution and fines
    • Court may order restitution to the victim for stolen or damaged property
    • Fines can range from hundreds to thousands of dollars

If either suspect has prior convictions or if the burglary involved forced entry or damage, sentencing enhancements may apply.
