In the early morning hours of September 28th, Daniel Warn of Rialto decided to break into the Big E Market at 890. N. Batavia St., according to the Orange Police Department.
Apparently, Warn thought stealing cigarettes and money was a great idea. He didn’t realize the Orange police detectives are good at what they do.
Within two days, they arrested Warn after they noticed he was wearing the same clothing as he did when he committed the burglary.

Needless to say, Warn was booked at Orange County Jail for commercial burglary.
Daniel Warn, if convicted of commercial burglary under California Penal Code § 459 (second-degree burglary), could face the following penalties:
- Misdemeanor charge:
- Up to 1 year in county jail
- Fine of up to $6,000
- Felony charge:
- 16 months, 2 years, or 3 years in county jail
- Fine of up to $10,000
Whether the charge is filed as a misdemeanor or felony depends on factors like:
- The value of the stolen items (if over $950, felony is more likely)
- Warn’s criminal history
- The circumstances of the crime, such as time of entry and level of planning.
