Police officers recently responded to a disturbance at a local hotel after an employee overheard two guests arguing, according to the Fountain Valley Police Department.

The investigation revealed the couple’s verbal argument had escalated into a physical assault, and the suspect attempted to prevent the victim from leaving or calling for help.

The suspect was arrested for felony domestic violence and false imprisonment, with additional charges requested.

An Emergency Protective Order was granted, and several firearms were seized in accordance with domestic violence firearm restrictions.

Here are the likely penalties under California law for the charges mentioned:

  • Felony Domestic Violence (Penal Code §273.5)
    • 2, 3, or 4 years in state prison
    • Fine up to $6,000 (or up to $10,000 with prior DV convictions)
    • Possible additional prison time if prior DV convictions exist (up to 5 years)
    • Mandatory domestic violence classes, restraining orders, and lifetime firearm ban
  • False Imprisonment (Penal Code §236)
    • Misdemeanor: Up to 1 year in county jail and/or $1,000 fine
    • Felony (with violence, menace, fraud, or deceit): Up to 3 years in county jail
  • Firearm Restrictions Violations
    • Domestic violence conviction triggers a lifetime firearm ban under federal law and California law
    • Possessing a firearm after a felony DV conviction: 16 months, 2 years, or 3 years in state prison and up to $10,000 fine
    • Violating a DV restraining order firearm prohibition can lead to additional felony charges
