Over the last three weeks, two male suspects have targeted a vacant building near 1120 E. 17th Street, committing three commercial burglaries, according to the SAPD.

The suspects stole copper pipes and air conditioning units, racking up more than $50,000 in stolen property and damages.

  • Suspect #1: Male, Hispanic, wearing all black clothing, and white shoes
  • Suspect #2: Male, Hispanic, wearing a black t-shirt, blue jeans, and white shoes

These suspects face serious charges for their criminal actions:

  1. Commercial Burglary (Penal Code § 459 PC):
    • This is considered second-degree burglary, which is a “wobbler” offense—meaning it can be charged as either a misdemeanor or a felony.
    • Felony penalties include:
      • Up to 3 years in county jail
      • A fine of up to $10,000
    • Misdemeanor penalties include:
      • Up to 1 year in county jail
      • A fine of up to $1,000 
  2. Sentencing Enhancements Under AB 1960 (2025 Law):
    • Because the value of stolen property and damages exceeds $50,000, the suspects may face additional prison time.
    • AB 1960 mandates stricter penalties for felony crimes involving high-value property damage or theft.
    • Enhancements could include:
      • Longer prison sentences
      • Extended probation terms
      • Additional fines or restitution requirements 
  3. Other Possible Charges:
    • If the suspects are found to have damaged HVAC systems or copper piping, they could also be charged with vandalism or grand theft, both of which carry their own penalties.
    • If they are part of an organized effort or repeat offenders, prosecutors may pursue organized retail crime charges, which carry up to 3 years in jail.
