On Monday, police officers investigated a theft from Walmart and detained a woman who had left without paying for CDs and other items, according to the Irvine Police Department.

It is hard to believe that CDs are still in production or that someone would bother to steal them.

After lying about her name, the suspect was identified and the offficers learned that she was on probation.

The 30-year-old from Costa Mesa was booked at the Orange County Jail for a probation violation, possession of drugs, and drug paraphernalia.

Based on the reported charges, the woman could face the following penalties under California law:

  • Probation violation
    • Penalty: up to the maximum sentence of the original offense
    • Judge may revoke probation and impose jail or prison time
    • Possible additional probation conditions or mandatory treatment
  • Possession of controlled substances (Health & Safety Code § 11350 or § 11377)
    • Misdemeanor or felony depending on the substance and prior record
    • Penalty: up to 1 year in county jail (misdemeanor) or 16 months to 3 years (felony)
  • Possession of drug paraphernalia (Health & Safety Code § 11364)
    • Misdemeanor offense
    • Penalty: up to 6 months in county jail
    • Possible fines and mandatory drug education or treatment
  • Petty theft (Penal Code § 484/488)
    • If the value of stolen items was under $950
    • Misdemeanor offense
    • Penalty: up to 6 months in county jail and/or fines
  • Providing false information to a peace officer (Penal Code § 148.9)
    • Misdemeanor offense
    • Penalty: up to 6 months in county jail

If she has prior convictions or is on formal probation for a felony, the penalties could be enhanced.
