Community: Notice to Residents: Cancellation of Public Hearing to Consider Ward Re-Boundaries

The Santa Ana City Council has canceled the Public Hearings to consider modifying the Ward boundaries. The Hearings were originally scheduled for May 1, May 3, May 15, May 19 and June 5, 2018.

The purpose of these Hearings was to allow interested persons to provide input on ward boundaries, community of interest and comment on proposed draft maps before the City Council for consideration. The City Council was unable to hold a formal public hearing on May 3, 2018 due to lack of quorum and at the May 15, 2018 City Council Meeting, the Clerk of the Council announced that the process was being suspended due to impending litigation.

As background, the City of Santa Ana received a certified letter on March 14, 2018 from Asian Americans Advancing Justice threatening litigation under the California Voting Rights Act of 2001 (CVRA) if the City did not change to By-Ward Elections. The letter claimed that the City’s current practice of nominating by Ward and electing at-large diluted the ability of Asians (a protected class) to elect candidates of their choice or otherwise influence the outcome of Santa Ana’s council elections.

On April 30, 2018, the City of Santa Ana was officially served with a lawsuit asserting that the City failed to transition to ward-based elections within the time limits specified in California Elections Code §10010. Plaintiffs are seeking: (1) a declaration from the Court that the City’s at-large method of election to elect its City Council violates the California Voting Rights Act; (2) a preliminary and/or permanent injunction to prevent City from imposing or applying its current at-large method of election to elect a future City Council, and (3) requiring the City to implement a district-based election system. The City’s response to the summons is due by May 30, 2 018. The Court set a Case Management Conference on July 30, 2018.

AVISO A LOS RESIDENTES:
CANCELACIÓN DE AUDIENCIAS PÚBLICAS
PARA CONSIDERAR CAMBIO DE LINDEROS DE SECTOR

La Ciudad de Santa Ana ha cancelado las Audiencias Públicas para considerar modificar los linderos de Sectores. Las Audiencias estaban programadas para mayo 1, mayo 3, mayo 15, mayo 19 y junio 5 del 2018.

El propósito de estas Audiencias fue permitir a personas interesadas presentar opiniones sobre los linderos de los sectores, ofrecer “comunidad de interés” y comentar sobre los borradores de mapas propuestos considerados ante el Concejo Municipal. El Concejo Municipal no pudo celebrar una audiencia pública formal el 3 de mayo del 2018 debido a falta de quórum y en la sesión del Concejo Municipal del 15 de mayo del 2018, la Secretaria Municipal anunció que se suspendía el proceso debido a un litigio inminente.

Como antecedente, la Ciudad de Santa Ana recibió una carta certificada el 14 de marzo del 2018 de parte de Asian Americans Advancing Justice amenazando litigio bajo la Ley de Derechos Electorales de California del 2001 (CVRA, por sus siglas en inglés) si la Ciudad no cambiaba a elecciones por sectores. La carta afirmaba que la práctica actual de la Ciudad de nominar por Sector y elegir en general diluía la habilidad de los asiáticos (una clase protegida) para elegir candidatos de su preferencia o de otra manera influenciar el resultado de elecciones al Concejo de Santa Ana.

El 30 de abril del 2018, la Ciudad de Santa Ana fue demandada oficialmente, aseverando que la Ciudad no hizo la transición a elecciones por sector dentro del tiempo límite especificado en el Código Electoral de California §10010. Los Demandantes solicitan: (1) una declaración de la Corte de que el método de elección en general de la Ciudad para elegir a su Concejo Municipal infringe la Ley de Derechos Electorales de California; (2) un mandato preliminar y/o permanente para evitar que la Ciudad imponga o aplique su método actual de elección en general para elegir un Concejo Municipal futuro y (3) requerir que la Ciudad implemente un sistema de elección por distritos (por sectores). La Ciudad debe responder al citatorio para el 30 de mayo del 2018. La Corte estableció una Conferencia de Gestión de Casos el 30 de julio del 2018.
