Santa Ana City Manager Kristine Ridge today signed an executive order extending through July 28, 2020, the moratorium on evictions due to non-payment of rent by residential and commercial tenants impacted by COVID-19.

This action was taken due to the continued impacts of the COVID-19 pandemic on both residents and businesses, to prevent the proliferation of homelessness, and to protect public health. Gov. Gavin Newsom’s extended Executive Order N-66-20 authorizes local governments to impose such eviction moratoriums through July 28.

The Santa Ana City Council declared a local emergency on March 17, and City Manager Ridge ordered the moratorium on evictions on March 19. The moratorium’s end date was previously extended from May 31 to June 30.

Tenants are required to notify their landlord of their inability to pay rent in order to receive protections under the moratorium.

The eviction moratorium does not relieve affected tenants of their responsibility to pay rent or for any unpaid rent during the moratorium. Once the moratorium is over, a landlord may collect any unpaid rent, but may not charge late fees. Tenants will have up to six months following the expiration of the local emergency to repay any back rent due.

Moratoria en desalojos se extiende hasta el 28 de julio del 2020

Kristine Ridge, Gerente Municipal de Santa Ana, firmó hoy una orden ejecutiva que extiende hasta el 28 de julio del 2020 la moratoria en desalojos debido a impago de alquiler por inquilinos residenciales y comerciales afectados por COVID-19.

Esta medida se tomó debido a las repercusiones continuas de la pandemia del COVID-19 sobre los residentes y negocios, para prevenir la proliferación de la indigencia y para proteger la salud pública. La Orden Ejecutiva N-66-20 extendida del Gob. Gavin Newsom autoriza a gobiernos locales imponer dichas moratorias en desalojos hasta el 28 de julio.

El Concejo Municipal de Santa Ana declaró una emergencia local el 17 de marzo, y la Gerente Municipal Ridge ordenó la moratoria en desalojos el 19 de marzo. El fin de la moratoria se había extendido previamente del 31 de mayo al 30 de junio.

Los inquilinos tienen que notificar a los propietarios de su incapacidad de pagar el alquiler a fin de recibir protecciones bajo la moratoria.

La moratoria en desalojos no exime a los inquilinos afectados de su responsabilidad de pagar el alquiler o de cualquier alquiler no pagado durante la moratoria. Una vez que termine la moratoria, un propietario puede colectar todo alquiler no pagado, pero no puede cobrar cargos por pago atrasado. Los inquilinos tendrán hasta 6 meses luego de la expiración de la emergencia local para pagar cualquier alquiler atrasado.
