Armed man arrested on a slew of felony charges after a DUI collision in Fountain Valley

Police officers recently responded to a solo vehicle traffic collision, according to the Fountain Valley Police Department.

During a search of the vehicle, the police officers located shell casings inside the vehicle and a loaded handgun nearby.

The driver was ultimately arrested for a slew of firearm charges, DUI Drugs, and several narcotics violations.

The driver was also identified as the suspect in a 2023 theft case.

Additional charges are pending.

Penalties for firearm charges, DUI drugs, and narcotics violations in California:

Firearm Charges

California has strict firearm laws, and penalties can vary based on the specific offense:

  • Unlawful Possession of a Firearm: This can lead to felony charges with penalties including imprisonment for 16 months, two years, or three years.
  • Carrying a Concealed Weapon: Without a permit, this is illegal and can result in fines and imprisonment.
  • Assault with a Deadly Weapon: Using a firearm to threaten or harm someone can lead to significant penalties, including imprisonment.

DUI Drugs

Driving under the influence of drugs (DUID) is treated similarly to alcohol-related DUIs:

  • First Offense: Penalties can include 3 to 5 years of probation, fines around $1,800, DUI school, license suspension, and possibly jail time.
  • Felony Charges: If it’s a fourth offense, involves a prior felony DUI, or causes injury, penalties can include up to three years in jail and fines up to $5,000.

Narcotics Violations

Penalties for drug-related offenses depend on the type and amount of the substance:

  • Simple Possession: Typically charged as a misdemeanor, with penalties including probation, fines, or up to one year in county jail.
  • Distribution and Trafficking: These are more severe, often resulting in felony charges with sentences ranging from three to nine years in state prison.
  • Manufacturing: Producing controlled substances like methamphetamine can lead to severe penalties, including long prison sentences.
