A suspect followed an Amazon driver into a secured apartment mailroom on Spectrum and walked out with packages that weren’t his, according to the Irvine Police Department.

The Irvine Police thought the suspect looked like AJ McLean from the Backstreet Boys.

Here are the potential penalties the suspect could face under California law:

  • Mail Theft (Penal Code §530.5(e))
    • Classified as a misdemeanor.
    • Punishable by up to 1 year in county jail and/or a fine up to $1,000.
  • Petty Theft (if stolen items are worth under $950)
    • Usually a misdemeanor.
    • Punishable by up to 6 months in jail and/or fines.
  • Grand Theft (if stolen items exceed $950)
    • A “wobbler” offense (can be charged as misdemeanor or felony).
    • Felony: Up to 3 years in state prison.
    • Misdemeanor: Up to 1 year in county jail.
  • Burglary (entering a secured mailroom with intent to steal)
    • Second-degree burglary (non-residential) is a wobbler.
    • Felony: Up to 3 years in prison.
    • Misdemeanor: Up to 1 year in jail.
  • Identity Theft (if personal info was taken)
    • Also a “wobbler.”
    • Felony: Up to 3 years in prison.
    • Misdemeanor: Up to 1 year in jail.
