On Monday morning, police officers responded to a call of a man armed with a rifle standing on the roof of a residence, according to the Garden Grove Police Department.

When the officers arrived, the suspect retreated back inside the home.

The officers quickly secured the area and safely contained the situation. After repeated commands, the suspect exited the residence and was taken into custody without incident.

Thanks to the swift response and teamwork of our officers, what could have been a dangerous situation ended safely for everyone involved.

The GGPD is committed to protecting their community and ensuring the safety of residents.

Based on the situation described above, the suspect could face several serious criminal charges under California law. Here’s a summary of the potential penalties:

1. Brandishing a firearm (Penal Code 417)

  • If the suspect pointed or displayed the rifle in a threatening way, this could be charged as a misdemeanor or felony.
  • Penalties range from up to 1 year in county jail (misdemeanor) to 3 years in state prison (felony).

2. Assault with a deadly weapon (Penal Code 245(a)(2))

  • If the suspect aimed the rifle at anyone or created a credible threat, this is a felony.
  • Penalties include 2 to 4 years in state prison, plus possible fines.

3. Criminal threats (Penal Code 422)

  • If the suspect made verbal or implied threats that caused fear, this is a felony.
  • Penalties include up to 3 years in state prison.

4. Resisting or delaying a peace officer (Penal Code 148)

  • Retreating into the home and refusing to comply could lead to this misdemeanor charge.
  • Penalty: Up to 1 year in county jail.

5. Possession of a firearm by a prohibited person (Penal Code 29800)

  • If the suspect has a prior felony or restraining order, this adds a felony charge.
  • Penalty: Up to 3 years in state prison.

The exact charges and penalties depend on the suspect’s criminal history, whether the firearm was loaded, and if anyone was directly threatened. If convicted of multiple felonies, the suspect could face several years in prison.
