This morning, Orange County Sheriff deputies responded to the area of Park Lantern and Dana Point Harbor Drive for a vehicle collision involving a pedestrian.

The victim was located and transported to a local hospital.

The vehicle fled the area and, with the help of witnesses, was quickly located.

The suspect was detained for further investigation.

The victim succumbed to his injuries and was pronounced deceased at the hospital.

The victim has been identified as a 13-year-old boy however his identity was not disclosed by law enforcement.

Here are the potential penalties the driver could face under California law for a fatal hit-and-run involving a pedestrian:

  • Felony Hit-and-Run (Vehicle Code §20001)
    • Required when the accident causes injury or death and the driver flees.
    • Penalties:
      • As a misdemeanor: Up to 1 year in county jail and fines of $1,000–$10,000.
      • As a felony: 2, 3, or 4 years in state prison and fines of $1,000–$10,000.
      • Mandatory license suspension and DMV points.
  • Vehicular Manslaughter (Penal Code §192(c))
    • Applies if death resulted from negligent or unlawful driving.
    • With gross negligence:
      • Felony: 2, 4, or 6 years in state prison.
      • Misdemeanor: Up to 1 year in county jail.
    • Without gross negligence:
      • Usually a misdemeanor: Up to 1 year in county jail.
  • Aggravating Factors (can increase penalties):
    • Driving under the influence (DUI) can add separate charges like gross vehicular manslaughter while intoxicated, which carries 10 years or more in prison.
    • Prior criminal record or suspended license.
  • Additional Consequences
    • Restitution to the victim’s family.
    • Civil lawsuits for wrongful death.
    • Long-term impacts on criminal record and driving privileges
