Two loiterers including a probationer were arrested on weapons charges by SAPD officers

Santa Ana gang detectives were conducting proactive enforcement recently in the area of 1700 E. Dyer Rd. when they contacted two men who were loitering near a vehicle in the parking lot of a gas station, according to the SAPD.

One male suspect was found to be on probation and as such he was subject to search and seizure conditoins by police officers.

The detectives proceeded to search both suspects and their associated vehicle. They located two firearms during the search.

Both of the suspects were arrested and they were booked at the Santa Ana City Jail for various weapons violations.

In California, if a probationer is caught with a firearm, the consequences can be severe. Here are some potential penalties:

  1. Probation Violation Hearing: The individual will face a probation violation hearing where a judge will decide the outcome.
  2. Reinstatement of Probation: The judge may choose to reinstate probation under the same or modified conditions.
  3. Termination of Probation: The judge might terminate probation and impose the original suspended sentence or the maximum sentence allowed by law.
  4. Jail Time: Even if probation is reinstated, the judge may require the individual to serve up to one year in jail as part of the new conditions.
  5. Felony Charges: If the individual has a prior felony conviction, possessing a firearm can lead to felony charges, punishable by up to three years in state prison and fines up to $10,000.
