Yesterday, police officers responded to reports of a man loitering near a park restroom and causing a disturbance, according to the Huntington Beach Police Department.

Officers arrived and located the subject still loitering in the park. After further investigation, it was determined that the subject had been committing lewd acts in public in addition to the loitering.

The subject was arrested and booked for the charges.

Unfortunately, today the same suspect returned to the same park and repeated the same offenses. This time, given his consecutive arrest for the same behavior, officers completed a Probable Cause Declaration, and he was transported to County Jail for booking.

The suspect’s charges include l*wd acts in public and loitering near a restroom to engage in l*wd behavior.

HBPD remains committed to enforcing the law and holding offenders accountable. They will continue to investigate, arrest, and appropriately charge those who choose to commit crimes in Huntington Beach, including completing necessary legal declarations when warranted.

A simple message to those thinking about breaking the law in our city: Don’t come to Huntington Beach to commit crimes. You will be held accountable.

Here’s a summary of the penalties the suspect may face in Huntington Beach, California:


Lewd Acts in Public (Penal Code § 647(a)):

  • Misdemeanor offense
  • Up to 6 months in county jail
  • Fines up to $1,000
  • Possible probation, counseling, and stay-away orders
  • No mandatory sex offender registration unless combined with more serious charges

Loitering Near a Restroom for Lewd Acts (Penal Code § 647(d)):

  • Also a misdemeanor
  • Up to 6 months in jail
  • Fines up to $1,000

Repeat Offenses:

  • Judges may impose stricter penalties for repeat behavior
  • Could include longer jail time, higher fines, or mandatory behavioral programs
