In California, burglary is defined under Penal Code 459 PC as entering a building, room, or locked vehicle with the intent to commit theft or any felony. The penalties for burglary vary based on the degree of the crime:
- First-Degree Burglary: This involves burglary of a residence and is always charged as a felony. The penalties include:
- Felony probation
- 2, 4, or 6 years in state prison
- A fine of up to $10,000
- Second-Degree Burglary: This involves burglary of a non-residential structure (e.g., commercial property) and can be charged as either a misdemeanor or a felony. The penalties include:
- Misdemeanor: Up to 1 year in county jail
- Felony: 16 months, 2 years, or 3 years in state prison
Burglary is considered a serious offense, and the intent to commit a crime at the time of entry is a crucial factor in determining the charges.
