CHP officers responded to reports of several vehicles performing maneuvers in the parking lot of Tesoro High School, in San Juan Capistrano.

When the CHP officers arrived, the drivers fled.

A 20-year-old man from San Juan Capistrano, driving a blue Ford Mustang, exceeded 145 mph while trying to escape.

With the help of the Orange County Sheriff’s Department helicopter and CHP-Riverside, the driver was eventually captured after abandoning the car and attempting to flee on foot.

The suspect was wearing a black hoodie with the words “Don’t get caught” on the back. He was arrested and charged with felony evasion. He was most likely booked at the Orange County Jail and given a change of clothes.

Penalties faced by the suspect

The 20-year-old man from San Juan Capistrano is facing serious penalties for his criminal actions.

Under California law (Vehicle Code 2800.2), felony evading carries the following penalties:

  • Prison time: 16 months, 2 years, or 3 years in state prison
  • Fines: Up to $10,000
  • Driver’s license: Suspension or revocation
  • Criminal record: A felony conviction that can impact future employment, housing, and more

Aggravating factors that can increase penalties include:

  • Causing injury or death during the pursuit
  • Fleeing in a school zone or residential area
  • Having prior convictions
  • Endangering passengers or the public

While the suspect’s hoodie message isn’t a legal factor, it could be used in court to show a lack of remorse or intent to mock law enforcement.
