Yesterday morning, while conducting proactive patrols at a local park, police officers observed an individual smoking in violation of the Huntington Beach Municipal Code, according to the Huntington Beach Police Department.

Upon contact and further investigation, the individual was found to be in possession of narcotics and drug paraphernalia.

Officers discovered this was not the suspect’s first or second arrest for similar offenses. Due to his repeated criminal history, the suspect was arrested and additionally charged with felony possession under Health & Safety Code 11395.

The HBPD remains committed to proactive enforcement and keeping our community safe from those who come to our City to break the law.

Wouldn’t it be nice if the SAPD would also arrest suspects for using drugs in public???

Under California Health & Safety Code § 11395, the suspect—who has prior drug-related convictions—faces the following:

  • Felony charge for possession of hard drugs (like meth, heroin, cocaine, fentanyl, or PCP).
  • Eligibility for treatment instead of jail: If the court finds the suspect suitable, they can enter a court-approved treatment program. If completed successfully, the charge is dismissed.
  • If treatment is refused, failed, or violated: The suspect may face up to 1 year in county jail or state prison time, especially due to repeat offenses.
  • Judicial review is required before any release to ensure public safety.
