The suspect was stopped, taken into custody, and booked into the HBPD Jail. The bicycle was safely returned to its rightful owner.
the HBPD thanks the witness who called it in —your awareness made all the difference. Remember, crime doesn’t pay in Huntington Beach.
In California, the suspect arrested for stealing a bicycle in Huntington Beach would most likely be charged under Penal Code § 499b PC, which covers the unlawful taking of a bicycle.
Key Points of the Law:
- It is a misdemeanor offense.
- The law applies even if the bicycle was taken temporarily and without the intent to permanently deprive the owner.
- This is sometimes referred to as “joyriding” for bicycles.
Penalties for Bicycle Theft under PC § 499b:
- Up to 3 months in county jail
- A fine of up to $400
- Or both jail time and a fine
If the suspect had intended to permanently keep the bicycle or if the value of the bike exceeded $950, the charge could escalate to petty theft or grand theft, which carry harsher penalties.
