In response to community concerns, the City of Santa Ana and the Orange County Health Care Agency investigated and shut down over 100 sidewalk food vending locations that were found to be selling food unfit for human consumption and operating without the proper health permit over the past six weeks.

The City’s Code Enforcement Division in partnership with the Health Care Agency’s Environmental Health Division (EHD) conducted the operation, accompanied by Santa Ana Police Department personnel.

“While enjoying meals from street vendors has become popular, we cannot allow unsafe food conditions to endanger public health,” Mayor Valerie Amezcua said. “I applaud City and County staff’s efforts to protect our residents.”

Under the California Retail Food Code, certain food-vending facilities, including food trucks and mobile food vendors, are required to obtain the proper health permit and authorization from the local public health agency. As part of the joint enforcement effort, it was determined that the sidewalk vendors did not possess the proper permit to operate, the food being sold and distributed was prepared and maintained outside the requirements of State standards, i.e., Retail Food Code, and that the food was unsafe. Accordingly, EHD inspectors with the assistance of City staff, as authorized by Health and Safety Code section 114393, impounded the food.

California law under SB 946 severely limits local governments from regulating or prohibiting sidewalk vending outright. City Code Enforcement and Orange County EHD staff will continue to conduct additional inspections to ensure that those that are operating do so safely and with the proper health permits. In addition to collaborating with the County, City staff will initiate a revision to the Santa Ana Municipal Code to augment the City’s ability to regulate, enforce, and address local concerns related with this type of food vending.

When buying food from a street vendor, members of the public are advised to check that a health permit is displayed.

Respondiendo a las preocupaciones de la comunidad, la Ciudad de Santa Ana y la Agencia de Cuidado de Salud del Condado de Orange investigaron y cerraron más de 100 locales de venta de comida en las banquetas que vendían alimentos inadecuados para el consumo humano y operaban sin el permiso de salud necesario durante las últimas seis semanas.

La División de Cumplimiento de Códigos de la Ciudad junto con la División de Salud Ambiental (EHD) de la Agencia de Cuidado de Salud realizaron la operación, acompañados por oficiales del Departamento de Policía de Santa Ana.

“Aunque disfrutar de las comidas de los vendedores en la calle se ha vuelto popular, no podemos permitir que las condiciones de la comida pongan en peligro la salud pública”, dijo la Alcaldesa Valerie Amezcua. “Aplaudo a los esfuerzos de los empleados de la Ciudad y el Condado protegiendo a nuestros residentes.”

Respecto al Código de Ventas de Alimentos de California, ciertas instalaciones de venta de comida, incluyendo a los camiones de comida y los vendedores ambulantes, deben obtener el permiso de salud adecuado y la autorización de la agencia de salud pública local. Como parte del esfuerzo de cumplimiento, se determinó que los vendedores en las banquetas no poseían el permiso adecuado para operar, y los alimentos que se vendían y distribuían se prepararon y mantuvieron fuera de los requisitos de las normas estatales, es decir, el Código de Ventas de Alimentos, y que la comida no era segura. En consecuencia, los inspectores del condado con la ayuda de los empleados de la Ciudad, autorizados por la sección 114393 del Código de Salud y Seguridad, confiscaron la comida.

La ley de California bajo SB 946 limita severamente a los gobiernos locales de regular o prohibir la venta en las banquetas. Empleados del Cumplimiento del Código de la Ciudad y del Condado de Orange continuarán realizando inspecciones adicionales para garantizar que aquellos que están operando lo hagan de manera segura y con los permisos de salud adecuados.
