Are the police acting illegally when conducting these DUI checkpoints?

There was a court decision that cops cannot take away cars from immigrants at these checkpoints, but the SAPD does so anyway.
I'm trying to imagine what law could be being broken by the police setting up a checkpoint? I'm surprised they are publicizing it in advance. Maybe that's it, because hotshot lawyers get courts to do things like requiring posting in advance or the Miranda Rights everyone is talking about revisiting. Heck if they can do that they ought to be able to make busting somebody for doing something wrong illegal also.
