A released high risk sex offended was arrested again by the SAPD

Today, April 30, 2020, Rudy William Grajeda Magdaleno was arrested. Magdaleno is a high-risk registered sex offender that was released from the Orange County Jail on April 13, 2020, after serving 71 days in jail. Magdaleno was given credit of an additional 71 days totaling 142 days credit time served on a parole violation for failing to charge GPS monitor, despite a 180-day minimum sentence.

Magdaleno was released with a GPS monitor and he once again failed to charge the device. The GPS monitor stopped tracking him just three days later on April 16, 2020. On April 17, 2020, Santa Ana Police were dispatched to a parole resource center after Magdaleno was reported to have exposed himself to staff members. Magdaleno fled the scene before police arrived. On April 20, 2020, a parole warrant was issued for his arrest.

Magdaleno has an extensive criminal history that includes prior convictions for Robbery, Narcotics possession, Assault and Battery, Elder/Dependent Adult Abuse, Assault with a Deadly Weapon, Criminal Threats and Child Annoyance.

“The arrest of this dangerous sex offender just days after he walked out of jail demonstrates the Court’s grave error in releasing him and six other high-risk sex offenders early,” Santa Ana Mayor Miguel A. Pulido said. “These ill-conceived decisions risk the safety of the Santa Ana community. I urge the Court to reconsider and place these criminals back behind bars for the remainder of their sentences.”

“On behalf of our Santa Ana community and all my officers that work diligently to help keep our City safe, I find it extremely troubling that this high risk sex offender was authorized for release, in spite of his significant documented criminal history. This high-risk offender has a track record of victimizing innocent people, without impunity” said Santa Ana Police Chief David Valentin.

On January 17, 2019, Magdaleno was arrested after he broke into a Santa Ana home while naked from the waist down. The home was occupied by an 11-year-old girl and her mother. Magdaleno was reported to be peeking into the child’s room while covering his penis with his hand. The child and her mother locked themselves in a bathroom and Magdaleno fled but was arrested by police a few blocks away.

On May 24, 2018, Magdaleno entered a law office located in Santa Ana, removed his shoes, sat on the floor and began to masturbate while staring at an adult female in the office. Magdaleno fled the scene and was later identified after his arrest in January of 2019. Magdaleno was convicted of indecent exposure on both cases.

On May 7, 2010, Magdaleno attacked a 41-year-old mentally disabled person at a restaurant located in Santa Ana. During the attack, Magdaleno forced the victim to orally copulate him. Magdaleno was arrested and convicted of abuse of a dependent adult.

Santa Ana Police Detectives began an extensive search for Magdaleno, located him today and took him into custody. He was booked at the Orange County Jail for the parole warrant and held without bail.

Detectives are actively investigating the indecent exposure, as well as the failure to register, and will seek additional charges.

Santa Ana Police Department Detectives believe Magdaleno may have committed other crimes due to his actions and criminal history.
