The Santa Ana rent hike freeze and moratorium on evictions are ending

The City of Santa Ana’s residential rent increase freeze will expire on May 31, 2020. City Manager Kristine Ridge has extended the moratorium on residential and commercial evictions through June 30, 2020.

The measures were put in place following the City Council’s declaration of a local emergency on March 17 due to the COVID-19 pandemic. The executive order prohibiting evictions and foreclosures was signed on March 19 and the order stopping rent increases went into effect on April 7.

The City’s moratorium on foreclosures also ends May 31, but the Federal Housing Administration (FHA) has extended its foreclosure and eviction moratorium through June 30, 2020, for homeowners with FHA-insured Single Family mortgages.

The eviction moratorium does not relieve affected tenants of their responsibility to pay rent or for any unpaid rent during the moratorium. Once the moratorium is over, a landlord may collect any unpaid rent, but may not charge late fees. Tenants will have up to six months following the expiration of the local emergency to repay any back rent due.

La Congelación de la Subida de Alquileres Termina el 31 de Mayo; la Moratoria de Desalojos se Extiende Hasta el 30 de Junio

La congelación del aumento de la renta residencial de la Ciudad de Santa Ana expirará el 31 de mayo de 2020. La gerente municipal, Kristine Ridge, ha extendido la moratoria de los desalojos residenciales y comerciales hasta el 30 de junio de 2020.

Las medidas entraron en vigor luego de la declaración del Ayuntamiento de una emergencia local el 17 de marzo debido a la pandemia de COVID-19. La orden ejecutiva que prohíbe los desalojos y ejecuciones hipotecarias se firmó el 19 de marzo y la orden para detener los aumentos de alquiler entró en vigor el 7 de abril.

La moratoria de ejecuciones hipotecarias de la Ciudad también finaliza el 31 de mayo, pero la Administración de Vivienda Federal (FHA) ha extendido su moratoria de ejecución hipotecaria y desalojo hasta el 30 de junio de 2020 para propietarios con hipotecas unifamiliares aseguradas por la FHA.

La moratoria de desalojos no exime a los inquilinos afectados de su responsabilidad de pagar el alquiler o cualquier alquiler no pagado durante la moratoria. Una vez que finaliza la moratoria, el arrendador puede cobrar el alquiler impago, pero no puede cobrarle un recargo por pago atrasado. Los inquilinos tendrán hasta seis meses después del vencimiento de la emergencia local para reembolsar cualquier renta atrasada.
