HOMELESS MAN CONVICTED OF HOME BURGLARIES STARTING WITH SEXUAL ASSAULT OF SLEEPING 10-YEAR-OLD GIRL
SANTA ANA – A homeless man was convicted today of sexually assaulting a 10-year-old girl who was asleep in her home and a string of residential burglaries in Buena Park. Joel Solis Aguirre, 24, Fullerton, was found guilty by a jury of one felony count of residential burglary, one felony count each of assault with intent to commit a sexual offense during a residential burglary, lewd act upon a child under 14 years old, attempted kidnapping to commit a sexual offense, attempted kidnapping for child molesting and attempted residential burglary. The sentencing allegations and enhancements for having a non-accomplice present during three residential burglaries and committing a lewd act during the commission of a burglary were found true. On Aug. 21, 2013, the defendant pleaded guilty to two counts of residential burglary in this case. Aguirre faces a maximum sentence of life in state prison and mandatory lifetime sex offender registration at his sentencing Nov. 8, 2013, at 9:00 a.m. in Department C-29, Central Justice Center, Santa Ana.
At approximately 2:00 a.m. on June 22, 2010, Aguirre entered a locked and occupied home and stole property from the downstairs living area. He went upstairs to search for more property to steal and encountered 10-year-old Jane Doe. The defendant approached the victim and used a razor blade to cut her shorts from the waist down and told her to leave the upstairs living room with him approximately four times, with the intent to sexually assault her. Jane Doe began to cry and Aguirre fled the upstairs living area and exited through the front door. He left his fingerprints in the house.
During the early morning hours on June 25, 2010, and June 26, 2010, Aguirre entered two locked and occupied homes and took the victims’ wallets, purses, cell phones, and other property. Aguirre left his fingerprints inside the homes.
At approximately 2:00 a.m. on June 28, 2010, Aguirre attempted to break into a home. The victim called 911 and Aguirre hid in the bushes next to the residence. Buena Park Police Department (BPPD) arrived and located Aguirre and arrested him at the scene.
Aguirre’s mandatory lifetime sex offender registration will bar him from entering County recreational areas and City parks which have passed the Sex Offender Ordinance. BPPD investigated this case. Deputy District Attorney Nancy Hayashida of the Sexual Assault Unit is prosecuting this case.
