Forty-one year old Irvine mom charged with sexually assaulting 14-year old

This has been a bad week in Orange County, with two Santa Ana public school teachers arrested and facing sex charges with high school students at Godinez High and the Orange County High School for the Arts (OCHSA).  Now a 41-year old mother in Irvine, who “during the time of these incidents worked part time with kindergarten-age children at Peter’s Canyon Elementary School and also with the Tustin Unified School District as a behavioral interventionist” has been charged with sexually assaulted a 14-year old boy who came over to play with her son.   Here is the O.C. 41-YEAR-OLD MOTHER CHARGED WITH SEXUALLY ASSAULTING 14-YEAR-OLD BOY WHO CAME OVER TO HER HOUSE TO PLAY WITH HER SON

NEWPORT BEACH – A 41-year-old mother was charged today of committing lewd acts and orally copulating a 14-year-old boy who came over to her house to play with her son. Nicole Ethel McMillen, Irvine, is charged with four felony counts of lewd acts upon a child and two felony counts of oral copulation of a minor under 16 years old. If convicted, she faces a maximum sentence of six years and three months in state prison. She is currently out of custody after posting $50,000 bail and is scheduled to be arraigned March 19, 2012, at 8:30 a.m., in Department H-2, Harbor Justice Center, Newport Beach.

Between January and February 2012, McMillen is accused of having sexual contact with 14-year-old John Doe who was over at her house to play with his friends. She is accused of keeping a “fun” home where many children spent time with her children. During these incidents, she had at least one of her children at home.

On Jan. 2, 2012, McMillen is accused of committing a lewd act by fondling John Doe’s groin area over the clothing.

On Jan. 7, 2012, McMillen is accused of committing lewd acts on John Doe by touching his groin area over the clothing and touching his penis directly. She is also accused of orally copulating the victim.

On Jan 15, 2012, McMillen is accused of committing lewd acts on John Doe by touching his groin area over the clothing and touching his penis directly.

On Jan. 21, 2012, McMillen is accused of committing lewd acts on John Doe by touching his groin area over the clothing and touching his penis directly on two separate occasions.

On Feb. 8, 2012, McMillen is accused of touching John Doe’s penis over and under his clothing and orally copulating the victim.

John Doe told his mother about the unlawful sexual contact on Feb. 13, 2012, and the family reported the crime to the Irvine Police Department.

During the time of these incidents, the defendant worked part time with kindergarten-age children at Peter’s Canyon Elementary School and also with the Tustin Unified School District as a “behavioral interventionist.”

If convicted, McMillen’s lifetime registration as a sex offender would bar her from entering County recreational areas and City parks which have passed the Sex Offender Ordinance.
